terms of service

questies is a free focus timer. these terms are the necessary-but-boring part, kept as short and plain as we can. by using questies, you agree to them.

1. acceptance of these terms

The Questies brand, the questies.app website, and the installable Questies progressive web app (the 55-minute focus timer), together "Questies," are operated by voyanix LLC ("voyanix," "we," "us," "our"). Questies is offered to you conditioned on your acceptance, without modification, of the terms, conditions, and notices contained here (the "Terms"). Your use of Questies constitutes your agreement to all of these Terms. Questies is a free companion to Main Character Saga; we never charge you for it and never monetize your personal data. Please read these Terms carefully and keep a copy for your reference.

2. privacy

Your use of Questies is also governed by our Privacy Policy, which is incorporated into these Terms. In short: no accounts, no personal data we can read, and anything stored on our servers is anonymized or end-to-end encrypted.

3. no account, and your data

Questies needs no account, login, password, name, or email. Your timer, streaks, and history live in your browser, on your device. Optional features (device sync, allyship circles, and reminders) work through anonymous codes and invite links, not credentials. You are responsible for safeguarding any sync code or circle invite link you share, because anyone who has it can join that sync or circle. You own the data you create; voyanix owns Questies, its brand, and its software.

4. electronic communications

Visiting questies.app or sending us an email constitutes electronic communications. You consent to receive communications from us electronically, and you agree that all agreements, notices, disclosures, and other communications we provide to you electronically satisfy any legal requirement that such communications be in writing.

5. children

voyanix does not knowingly collect personal information, online or offline, from anyone under the age of 13. Questies is not directed to children, and because it requires no account and collects no personal information, exposure is minimal. If you are under 18, you may use Questies only with the permission of a parent or guardian.

6. license and intellectual property

You are granted a non-exclusive, non-transferable, revocable license to access and use Questies strictly in accordance with these Terms. As a condition of your use, you warrant to voyanix that you will not use Questies for any purpose that is unlawful or prohibited by these Terms. You may not use Questies in any manner that could damage, disable, overburden, or impair it, or interfere with any other party's use and enjoyment of it. You may not obtain or attempt to obtain any materials or information, or access the sync, circle, tally, or reminder infrastructure, through any means not intentionally made available or provided through Questies.

All content included in Questies, such as text, graphics, logos, line-art icons, the Monoton wordmark, images, software, and the compilation thereof, is the property of voyanix or its suppliers and is protected by copyright and other laws that protect intellectual property and proprietary rights. You agree to observe and abide by all copyright and other proprietary notices and restrictions, and you will not modify, publish, transmit, reverse engineer, participate in the transfer or sale of, create derivative works from, or in any way exploit any of the content, in whole or in part. Questies content is not for resale. You acquire no ownership rights in any protected content, and we grant you no licenses, express or implied, to the intellectual property of voyanix or our licensors except as expressly authorized by these Terms. You do own your own data, meaning the content on your device and your end-to-end-encrypted synced data; these Terms grant voyanix no license to read it.

7. feedback you send us

If you voluntarily send us feedback, suggestions, or ideas (for example, by email), you grant voyanix a royalty-free, worldwide license to use them to operate and improve Questies, and you represent that you have the right to send them. We are under no obligation to act on feedback or to keep it confidential. Questies' other user content (such as questie names, trail names, and synced data) stays on your device or is end-to-end encrypted and opaque to us, so these Terms claim no license over it.

8. third-party links and advertisers

Questies may link to third-party websites and, in the future, may show unobtrusive contextual ads (described in our Privacy Policy). Clicking a link or an ad takes you to a third party that is governed by its own terms and privacy policy. We vet advertisers for alignment with our values to the best of our ability, but we do not control and are not responsible for the content, products, practices, or off-site activity of any third party. Your dealings with third parties are solely between you and them.

9. international users

Questies is operated from the United States. If you access Questies from outside the United States, you are responsible for compliance with your local laws, and you may not use Questies where it is prohibited.

10. indemnification

You agree to indemnify, defend, and hold harmless voyanix, its officers, directors, employees, agents, and third parties for any losses, costs, liabilities, and expenses (including reasonable attorneys' fees) relating to or arising out of your use of or inability to use Questies, your violation of these Terms, your violation of any rights of a third party, or your violation of any applicable laws, rules, or regulations. voyanix reserves the right, at its own cost, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with voyanix in asserting any available defenses.

11. disclaimer of warranties and limitation of liability

QUESTIES IS PROVIDED FREE OF CHARGE AND "AS IS." THE INFORMATION, SOFTWARE, AND SERVICES INCLUDED IN OR AVAILABLE THROUGH QUESTIES MAY INCLUDE INACCURACIES OR ERRORS, AND VOYANIX LLC AND ITS SUPPLIERS MAY MAKE IMPROVEMENTS OR CHANGES AT ANY TIME. VOYANIX LLC AND ITS SUPPLIERS MAKE NO REPRESENTATIONS ABOUT THE SUITABILITY, RELIABILITY, AVAILABILITY, TIMELINESS, OR ACCURACY OF QUESTIES FOR ANY PURPOSE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, QUESTIES AND ALL RELATED INFORMATION, SOFTWARE, AND SERVICES ARE PROVIDED WITHOUT WARRANTY OR CONDITION OF ANY KIND, AND VOYANIX LLC AND ITS SUPPLIERS DISCLAIM ALL WARRANTIES AND CONDITIONS, INCLUDING ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT QUESTIES WILL BE UNINTERRUPTED OR AVAILABLE, OR THAT SYNC, REMINDERS, OR CIRCLES WILL ALWAYS FUNCTION.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL VOYANIX LLC OR ITS SUPPLIERS BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, OR ANY DAMAGES WHATSOEVER, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF USE, DATA, OR PROFITS, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR PERFORMANCE OF QUESTIES. IF YOU ARE DISSATISFIED WITH ANY PORTION OF QUESTIES OR WITH ANY OF THESE TERMS, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING QUESTIES.

12. arbitration

In the event the parties are not able to resolve any dispute between them arising out of or concerning these Terms, or any provisions hereof, whether in contract, tort, or otherwise at law or in equity for damages or any other relief, then such dispute shall be resolved only by final and binding arbitration pursuant to the Federal Arbitration Act, conducted by a single neutral arbitrator and administered by the American Arbitration Association, or a similar arbitration service selected by the parties, in a location mutually agreed upon by the parties. The arbitrator's award shall be final, and judgment may be entered upon it in any court having jurisdiction. In the event that any legal or equitable action, proceeding, or arbitration arises out of or concerns these Terms, the prevailing party shall be entitled to recover its costs and reasonable attorneys' fees. The parties agree that the Federal Arbitration Act governs the interpretation and enforcement of this provision. This arbitration provision shall survive the termination of these Terms.

13. class action waiver

Any arbitration under these Terms will take place on an individual basis. Class arbitrations, class actions, private attorney general actions, and consolidation with other arbitrations are not permitted, and claims may not be brought as a plaintiff or class member in any class, collective, or representative proceeding without the consent of all parties.

14. termination and governing law

voyanix reserves the right, in its sole discretion, to terminate your access to Questies and the related services, or any portion of them, at any time, without notice. To the maximum extent permitted by law, these Terms are governed by the laws of the State of Hawaii, and you consent to the exclusive jurisdiction and venue of the courts in Hawaii for all disputes arising out of or relating to the use of Questies. You agree that no joint venture, partnership, employment, or agency relationship exists between you and voyanix as a result of these Terms or your use of Questies. If any part of these Terms is determined to be invalid or unenforceable under applicable law, that provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original, and the remainder of these Terms will continue in effect.

15. changes to these terms

voyanix reserves the right, in its sole discretion, to change the Terms under which Questies is offered. The most current version of the Terms will supersede all previous versions. We encourage you to review the Terms periodically to stay informed of our updates.
